MEMORANDUM OF UNDERSTANDING

 

Pursuant to an interest in seeking temporary solutions to the current financial crisis that are time-limited, and which do not involve modifying the articles of the contract or changing contract language, the Association and the District agree to the following:

 

The November 12, 2009 Omniparty Consensus Agreement makes three significant changes that require faculty ratification.  The purpose of this MOU is to approve of those changes.

 

The first change specifies the redirection of growth funds in a manner that diverges from the default process specified in the Formula.  Instead of being spent on costs associated with new personnel, growth funds will be allocated as follows:

a)      use a portion of the available on-going growth funds to make up the highest unit bucket deficit and put a proportionate amount in the other unit buckets, and

b)      use the remainder of the available growth funds on a one-time basis to reduce the 2009-2010 deficit. 

 

The second change alters the default operation of the Formula with regard to attrition savings.  By default, these savings, which accrue as a result of positions being vacated, are credited back to the appropriate unit bucket.  The Omniparty Consensus Agreement will instead apply attrition savings to the deficit in 2009-2010 and 2010-2011.

 

The third change implements temporary reductions in pay.  For faculty, pay rates beginning July 1, 2010, and ending June 30, 2011 will be determined by first placing faculty members at the appropriate cell of the pay schedule outlined in Article 9 of the SCFA agreement.  Then, the amount specified by the Full-Time Faculty Salary Schedule will be reduced by 5%, and the rate specified by the Part-Time Faculty Salary Schedule will be reduced by 2.5%.

 

The parties also agree that the following conditions apply to this MOU: 

 

  1)  this agreement does not require or constitute any change to the contract language,

 

2)  in the absence of a subsequent agreement, at the expiration of this agreement faculty pay rates will revert to those specified in the contract, and

 

  3)  this agreement shall not be incorporated into any subsequent agreement unless

agreed to by all parties.

 

Further, the parties agree that the implementation of this agreement is contingent upon:

 

  1)  ratification by the SCFA membership in accord with SCFA Bylaws, and

 

2)  implementation of the 5% pay reductions also specified in the November 12, 2009 Omniparty Consensus Agreement for SCMA, FUSE, and the executive team.

MEMORANDUM OF UNDERSTANDING

 

When under difficult budgetary and enrollment conditions specified in Ed Code, the District has the right to implement reductions in programs and services through the elimination of positions.  The District has identified roughly $450,000 in cost savings it needs to realize through reductions in programs and services related to faculty positions that have contracts that extend beyond 175 days. 

 

Pursuant to an interest in seeking temporary solutions to the current financial crisis that are time-limited, and which do not involve modifying the articles of the contract or changing contract language, the Association and the District agree to the following:

 

As specified in the attached schedule, furlough days will be implemented for faculty positions that have contracts that extend beyond 175 days, beginning July 1, 2010, and ending June 30, 2012.  The furlough days will be used to generate savings that would otherwise be realized, in the absence of this agreement, through the elimination of positions.

 

The parties also agree that the following conditions apply to this MOU:

 

  1) this agreement does not require or constitute any change to the contract language,

           

2)  in the absence of a subsequent agreement, at the expiration of this agreement faculty work days will revert to those specified in the contract, and

 

   3) this agreement shall not be incorporated into any subsequent agreement unless

agreed to by all parties.

 

Further, the parties agree that the implementation of this agreement is contingent upon ratification by the SCFA membership in accord with SCFA Bylaws.

MEMORANDUM OF UNDERSTANDING

 

The agreement between the Association and the District dated April 7, 2009 (SCFA 0809-03) requires the District to increase the number of full-time faculty an additional two FTEF above the otherwise required number for each year of the agreement, based upon a formula that is keyed to the Faculty Obligation Number (FON).

 

Pursuant to an interest in seeking temporary solutions to the current financial crisis that are time-limited, and in recognition of the difficult situation we find ourselves in with District employees facing potential layoffs, the Association and the District agree to the following:

 

The District’s obligation relative to the plus two portion of Agreement SCFA 0809-03 will be forgiven for the school year beginning July 1, 2010, and ending June 30, 2011.  The additional two positions forgiven by this agreement will not be added to the requirement for subsequent years.  Therefore, pursuant to this MOU, the District obligation for full-time faculty would be modified as follows:

 

2008 – 2009:            4 faculty over the FON

2009 – 2010:            4 faculty over the FON + 5 + 2

2010 – 2011:            4 faculty over the FON + 5 + 2

2011 – 2012:            4 faculty over the FON + 5 + 2 + 2

 

The parties also agree that the following conditions apply to this MOU:

 

   1) this agreement does not require or constitute any change to the contract language,

           

  2) in the absence of a subsequent agreement, at the expiration of this agreement  all terms of Agreement SCFA 0809-03 will be followed, and

 

    3) this agreement shall not be incorporated into any subsequent agreement unless

agreed to by all parties.

 

Further, the parties agree that the implementation of this agreement is contingent upon ratification by the SCFA membership in accord with SCFA Bylaws.
